SIMPLR HEALTH and its subsidiaries, or agents, reserve the right to refuse service, terminate accounts, and/or cancel orders at its discretion, including, without limitation, if SIMPLR HEALTH believes that customer conduct violates applicable law or is harmful to the interests of SIMPLR HEALTH and/or its subsidiaries, or agents.

SIMPLR HEALTH use of personal information that you may submit to SIMPLR HEALTH through this Web site, or by other means as may be conducted, is governed by the SIMPLR HEALTH Privacy Policy.

5. Shipping & Delivery

At this time, SIMPLR HEALTH ships merchandise to locations within Australia. The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

6. GST

SIMPLR HEALTH charges Goods and Services Tax (GST), as determined applicable by the product ordered on this Web site, based on the applicable GST rate, the location from which product is shipped, and the location to which the order is being shipped.

7. Miscellaneous

VOID WHERE PROHIBITED: Although the information on this Web site is accessible worldwide, not all products or services discussed in this Web site are available to all persons or in all geographic locations or jurisdictions. SIMPLR HEALTH, other listees and/or the advertisers each reserve the right to limit the provision of their products or services to any person, geographic area, or jurisdiction they so desire and to limit the quantities of any products or services that they provide. Any offer for any product or service made in the materials on this Web site is void where prohibited. 

8. GOVERNING LAW

In the event of litigation both parties agree that the Law of the address of business registration of SIMPLR HEALTH shall apply and both parties shall consent to the jurisdiction of said courts. Both parties expressly waive a trial by jury.

9. PRODUCT Returns and RefundS 

If a product you buy from SIMPLR HEALTH is faulty or out of date we will cheerfully refund the purchase price or exchange the product. We do not refund opened or used products due to the speciality of the product and program. SIMPLR HEALTH advises that you contact your centre and or centre coach to discuss any exchange they may be willing to offer. To make a claim under our Returns Policy, please contact trevor@simplr.health and return the item to your enrolled centre for assistance. Or, if you are a virtual dieter please send the item(s) to the following address after arrangements have been agreed upon:

Any cost incurred by the customer in returning the item to the distribution centre will be borne by the customer.

10. Coaching Programs – No Refund Policy

At SIMPLR HEALTH, we are committed to providing high-quality coaching programs designed to empower individuals on their health and wellness journeys. To maintain the integrity of our services and ensure a consistent experience for all clients, we have established the following No Refund Policy, which applies to all coaching programs, including but not limited to one-on-one coaching, group coaching, online courses, and memberships.

10.1. No Refunds
All purchases made for SIMPLR HEALTH coaching programs are non-refundable, regardless of participation, completion, or circumstances. Once payment is processed, no refunds, credits, or exchanges will be issued.

10.2. Commitment to the Program
Our coaching programs are designed to yield results through consistent participation and effort. By enrolling, clients acknowledge their commitment to the process and accept responsibility for their progress.

10.3. Rescheduling & Program Adjustments

While refunds are not provided, we understand that unforeseen circumstances may arise. Clients may request to:

•  Reschedule sessions (where applicable) with a minimum of 24 hours notice, subject to availability.

•  Transfer their program to another individual, pending approval from SIMPLR HEALTH.

•  Pause their program for a specified period, if permitted by the terms of their individual agreement.

10.4. Exceptional Circumstances

SIMPLR HEALTH reserves the right to review refund requests on a case-by-case basis in extraordinary circumstances, such as documented medical emergencies. Any decision made by SIMPLR in these cases is final.

10.5. Program Termination

SIMPLR HEALTH reserves the right to terminate a client’s participation in the program due to violation of program policies, inappropriate behaviour, or non-compliance with the coaching guidelines. In such cases, no refunds will be issued.

10.6. Acknowledgment and Agreement

By enrolling in a SIMPLR HEALTH coaching program, clients acknowledge that they have read, understood, and agreed to this No Refund Policy.

11. General

SIMPLR HEALTH may amend these terms and conditions at any time without notice. Accordingly, you should periodically re-visit these terms and conditions to review the then-current terms and conditions governing your use of this website. If any part of these terms and conditions is unlawful, void or unenforceable, then that part is severable and will not affect the validity and enforceability of the remaining terms and conditions.
